Open Society Condemns Travesty of Justice in Kavala Verdict

New York, April 25, 2022 (GLOBE NEWSWIRE) — The Open Society Foundations are appalled by today’s Turkish court decision to sentence Osman Kavala—the business leader and philanthropist—to life in prison, even though no credible evidence was ever presented to substantiate the baseless charges against him.

“Today a Turkish judge ruled against Osman Kavala even though there is not a shred of legitimate evidence against him,” said Mark Malloch-Brown, the president of the Open Society Foundations. “This bogus trial has utterly failed to meet the most basic standards for fairness and procedural justice.”

The court in Istanbul also sentenced seven other defendants to 18 years in prison each. The cases against these defendants were also without any merit.

Osman Kavala was first arrested and detained in October 2017. The government has held him, without conviction prior to today, for more than four years.

During that time, Turkish prosecutors have bent over backwards to try to keep Kavala in prison, even having him re-arrested in February 2020, after a previous trial ended with him being briefly released.

“This is not about justice,” added Malloch-Brown. “It is about trying to intimidate and silence anyone who might speak up in defense of human rights in Turkey, including all independent civil society groups.”

In December 2019, the European Court of Human Rights (ECHR) ruled that Kavala’s detention was unjustified, and that the case against him was designed to silence him and to dissuade other human rights defenders from speaking out.

Turkey has so far defied the ECHR ruling.

Kavala is an established businessman and philanthropist, known for his support of human rights, the arts, and culture in Turkey. He also served as a board member with Open Society’s foundation in Turkey. (Open Society Turkey shut its doors in 2018 due to harassment from the Turkish government.)

Kavala is expected to appeal the court ruling.

“It is long past time to end this legal farce,” added Malloch-Brown. “Osman Kavala should be released and his name cleared immediately.”

Fitch gives Stanbic positive credit rating

Fitch, an international credit rating agency has affirmed Stanbic’s long-term issuer default rating at B+ while it maintained its ‘AAA’ rating in Uganda.

The ratings simply mean the bank has the lowest expectation from the agency to default on any payments of financial commitments in Uganda.

Stanbic is the largest bank by both assets and profitability in the banking sector.

“We welcome the positive rating by Fitch which speaks to the stability of our business and ability to support Uganda’s economic growth in a challenging operating environment,” Anne Juuko, the Stanbic chief executive said in a statement.

“The stable outlook reflects our view that Stanbic creditworthiness compared to other domestic issuers is unlikely to change over a one to two-year period. Stanbic’s profitability is expected to further recover in 2022 resulting from a likely rise in Uganda’s interest rates and stronger loan growth,” she added.

Stanbic's net profits grew by 11% as at end of December 2021 pegged largely to diversity in the bank’s revenue streams and good credit risk management for the period.

Customer deposits—money that clients trust with the bank for safe custody grew by 5% to sh5.7 trillion. Total loans and advances to borrowers grew by 3% or sh104b during the period.

The bank’s non-performing loans (NPLs) dropped to 4.6% from 4.7% the previous year and saw provision reduce to sh70b from sh92b in 2020.

Operating costs increased by 14% or sh61b to sh482b in 2021. This was attributed to continued investment in infrastructure to enhance the bank’s digital capabilities and other operational loss provisions.

Infrastructure key for e-commerce growth

If there is any sector that saw great uptake during the 2020-2022 pandemic-induced lockdowns, it was e-commerce. However, challenges remain.

According to Ronnie Kawamara, the Jumia Uganda chief executive officer, e-commerce uptake is growing so fast, but there is no adequate infrastructure to support its growth.

“Uganda is a fast-growing market the young people aged from 16 – 25 are the majority and very tech-savvy. They know what is good for them. However, to build a tech company in Uganda, you must invest in a lot due to lack of (proper) infrastructure,” he said during the interaction with 25 students from Stockholm School of Economics, Sweden during their benchmarking visit at Jumia offices in Bugoloobi today, April 26, 2022.

Kawamara says Jumia has been able to grow in Uganda in the last 10 years because they have been able to build their own infrastructure.

“In the last ten years, we have built our robust infrastructure like warehouses and logistics. If you are here you need to deal with these challenges,” he added.

“Tech-savvy is still at the beginning in Uganda we need many players. There is a massive space to invest in,” he added.

According to the Report by Uganda National E-commerce Strategy by Ministry if ICT, the e-commerce market is expected to grow at a rate of 17.1 % between 2020 –2024 and the e-commerce user penetration is expected to hit 37.1% by 2024 because an increasing number of people are making purchases online.

According to Jumia, the country is ripe with over 50% of Ugandans who have access to mobile money, 6% have access to card payments and 36% have access to online payments.

K9 aid arrest of aggravated robbery, rape suspects

The territorial Police at Kawempe working with the K9 unit yesterday 25/04/2022 arrested four suspects in a case of Aggravated Robbery and Rape that was registered at Kanyanya Police station.

It is alleged that at about 12am, 2 Panga wielding thugs broke into the home of a 23-year-old woman in Kitambuza Zone, Kawempe Division, robbed and sexually assaulted the victim who was staying alone.

The victim reported the matter to Police. Officers from Kawempe Police working with K9 introduced Boela dog which helped track down the suspects for a distance of 250m from the crime scene.

The dog entered a structure that was harbouring four men who were arrested immediately after the victim’s identification.

She was able to identify the suspects by the clothes they were wearing during the incident.

The four suspects include; Katabi Joseph, Sserwada Mike, Musana John who was hiding inside the ceiling board and another one only identified as Musunguzi.

Upon lawful search of their premises, the Police recovered knives, pangas and suspected narcotic substances. They are currently detained at Kawempe Police station.

We have also established through investigations that the thugs gained access to the victim’s home by jumping over the fence and unbolting her door.

She was robbed of money amounting to 850,000 shillings, a phone and a Laptop before they sexually assaulted her. The gated houses where she was staying had a security guard but unfortunately, the guard claims not to have heard anything.

He has also been brought in for questioning. We want to thank Boela for the resolve in tracking down the assailants. The suspects will be arraigned in courts of law as soon as investigations are complete.

Police arrests notorious suspect

Detectives in Nansana have arrested a notorious thug and launched a manhunt for his accomplices following a series of robberies in the area.

The suspect identified as Ssozi Derrick 20 years was arrested during an intelligence-led operation in areas of Kisumu Village, Nabweru Division in Wakiso District on 24/04/2022 at around 1500 hrs.

Ssozi, a resident of the same area was found allegedly surveilling the area while carrying a backpack.

An immediate search was conducted and officers recovered the following items from his backpack; 01 Panga wrapped in a red cloth, 02 knives, 01cutter and 02 harmers. The bag is also suspected to be stolen.

Detectives proceeded to his place of residence where another search was carried out and several suspected stolen properties were recovered. These include; 02 television sets, 02 woofers, 02 fans, three master keys, 01 Techno smartphone, cash amounting to four million fifty thousand Ugandan shillings (4,050,000) and other household items valued at thirteen million (13 million) Shillings.

We also recovered two Motorcycles Reg nos. UFA 513J and UFL 408A suspected to be stolen, breaking implements, 03 Master keys, a cutter( blue cover), 05 Notes of South Sudanese pounds in the denomination of 50, 50 notes of Kenyan shillings, one hundred rupees, 05 suspected stolen mobile phones of infinix hot 10, W$Q (blue), Tecno smartphone, MI smart (pink) and itel buttons (mapeesa), a lap smart television, 02 sets of subwoofers HiFi and smart, 01 DVD player, 02 fans, 01 ADH refrigerator among others.

The team has intensified operations to find his colleagues who we suspect to have been working with him in these Robberies. We would like to applaud the Joint task team for the work done in Nabweru in recovering these stolen items and making the arrest.

The community is urged to remain vigilant so as to fight criminal gangs in their areas of residence.

The suspect is currently detained by Nansana police as investigations continue.

Tesla Value Falls $126 Billion Amid Musk Twitter Deal Funding Concerns

Tesla lost $126 billion in value on Tuesday amid investor concerns that Chief Executive Elon Musk may have to sell shares to fund his $21 billion equity contribution to his $44 billion buyout of Twitter.

Tesla is not involved in the Twitter deal, yet its shares have been targeted by speculators after Musk declined to disclose publicly where his cash for the acquisition of Twitter is coming from. The 12.2% drop in Tesla's shares on Tuesday equated to a $21 billion drop in the value of his Tesla stake, the same as the $21 billion in cash he committed to the Twitter deal.

Wedbush Securities analyst Daniel Ives said that worries about upcoming stock sales by Musk and the possibility that he is becoming distracted by Twitter weighed on Tesla shares.

"This (is) causing a bear festival on the name," Ives said.

Tesla did not immediately respond to a request for comment.

To be sure, Tesla's share plunge came against a challenging backdrop for many technology-related stocks. The Nasdaq closed at its lowest level since December 2020 on Tuesday, as investors worried about slowing global growth and more aggressive rate hikes from the U.S. Federal Reserve.

Twitter's shares also slid on Tuesday, falling 3.9% to close at $49.68 even though Musk agreed to buy it on Monday for $54.20 per share in cash. The widening spread reflects investor concern that the precipitous decline in Tesla's shares, from which Musk derives most of his $239 billion fortune, could lead the world's richest person to have second thoughts about the Twitter deal.

"If Tesla's share price continues to remain in freefall that will jeopardize his financing," said OANDA senior market analyst Ed Moya.

As part of the Tesla deal, Musk also took out a $12.5 billion margin loan tied to his Tesla stock. He had already borrowed against about half of his Tesla shares.

University of Maryland professor David Kirsch, whose research focuses on innovation and entrepreneurship, said investors started to worry about a "cascade of margin calls" on Musk's loans.

Beijing Begins Mass COVID-19 Testing Drive

Beijing has begun mass COVID-19 testing most of its 21 million residents amid fears the Chinese capital will be placed under a strict lockdown similar to the one imposed on Shanghai.

Authorities expanded testing across 11 districts Tuesday after launching the mass testing drive in Beijing’s most populous district of Chaoyang on Monday.

Beijing went on alert last week after 10 middle school students tested positive for COVID-19, sparking widespread panic buying across Beijing Sunday in anticipation of a possible citywide lockdown. Long queues were seen in supermarkets in the city center, as shoppers snapped up rice, noodles, vegetables and other produce, while store workers hastily restocked some empty shelves.

Officials have urged residents in some neighborhoods to work from home, and have started closing some venues such as gyms and theaters.

So far, only 70 positive cases have been reported since last week, including 33 new cases on Tuesday.

Meanwhile, Shanghai continues to struggle to contain an outbreak of new COVID-19 cases largely driven by the highly contagious omicron variant, with many of its 26 million residents still under orders to remain indoors. The lockdown has led to angry complaints of a lack of fresh food and medicine throughout China’s biggest city.

Shanghai reported well over 10,000 new coronavirus infections and at least 51 deaths on Tuesday.

THE ASSASSINATION ATTEMPT ON THE PRINCIPAL JUDGE WAS FROM A ROADSIDE EXPLOSIVE DEVICE

As you are all aware, the territorial police at Katonga Region and Mpigi, registered an incident of Attempted Murder, against the Principal Judge, His Lordship, Dr. Flavian Zaija, after his convoy was allegedly attacked by suspected gunmen on the 23.04.2022, at around 8:30pm, around Kalandezi village, Buwama in Mpigi district. As a result, a composite tactical team from Counter Terrorism, CMI, Forensics, Crime Intelligence, ISO and operations, visited the scene and condoned it off, for a thorough assessment.

We have since established that the attack on the convoy, was instead as a result of an improvised explosive device, planted on the road side, below the guard rail, at a remote location, in Kalandezi village. The task team recovered a variety of IED components that included; shattered detonator parts, pieces of wire, cut pieces of iron bars, shattered aluminum pieces, and metal fragments, all designed to increase the amount of shrapnel propelled by the explosive device. There were no bullets or cartridges at the scene. We are grateful that the Principal Judge and his team were not injured. The vehicle of the Principal Judge and the lead car, had minor damages from the impact of the metallic fragments.

We have further established that this is the second such type of incident, where IEDs are planted on the roadside, to either damage vehicles, along the road and incapacitate, injure or kill motorists. The first incident occurred, on the 17.04.2022, at around 9:30pm, when Busasira Alex, while driving in the company of his wife, from Kampala to Kabale in motor vehicle, registration number, UBJ399A, were hit by an IED, which was detonated and metallic shrapnel damaged his vehicle, along the Masaka-Kinoni section at Kyangoma LCI, Nkoni Parish, Kingo Sub-county, Lwengo district. Their vehicle was perforated by metallic pieces, some of which were picked from the body of the motor vehicle. The victims did not stop, despite the tyre burst and drove miles ahead. The following morning, our task teams, recovered metallic fragments, scattered around the scene.

We strongly condemn the cowardly attack and call for calm as we conduct further inquiries. Our tactical teams are now aware of this new kind of threats on our roads, targeting motorists. Although, there is no immediate claim of responsibility for the attack, the nature of the attack, roadside explosives and the timing in both incidents are similar. In addition, there is no evidence at this stage, to show whether the Principal Judge’s vehicle, was the intended target or a random incident of attack on any government vehicle.

We are going to ensure the perpetrators of this senseless attack who are trying to use violence to undermine the safety and security of motorists, are identified and brought to book. We wish to further remind all members of the public, that a threat environment still exists in the country, which calls for vigilance. We have criminal elements who have perfected the construction and use of IED’s capable of destroying vehicles, facilities and injuring or fatally wounding victims.

STATEMENT ON TELECOMMUNICATIONS FRAUD

There is an increase in cases of cyber-crime by people who pretend to be from telecommunication networks. The use of internet presents scammers with additional opportunities to reach potential victims and obtain your personal information. The absurd part is that most victims suffer quietly without reporting.

We have heard and received reports of fraudsters calling individuals and telling them that their sim card lines are not registered and they offer to help you register from a computer, claiming the card is going to be blocked or suspended, update your details, or remaining ten minutes. Once you fall in their trap and accept to register, they will take you through a complicated/complex process and you will not realise when your money on your phone has been taken.

Following a public outcry of increased cases of cyber-crime by fraudsters, the Territorial Police of Nansana on 23/04/2022 carried out an intelligence-led operation in areas of Nansana West 2A Kibulooka against organised criminal gangs of fraudsters dealing in fake minerals, electronic fraud and offensive communication. The Police arrested nine suspects and recovered suspected stolen items like 24 suspected stolen phones, suspected fake minerals, a laptop suspected to be used in cyber-crime, copies of land sales agreement, Visa ATM card, marijuana and a list of people who are believed to be their victims.

It has been established that the scene of crime was being used as a conference for the gang to carry out hoax calls to unsuspecting victims. The suspects lure their victims into believing that such calls are from telecommunications companies like MTN, Airtel and different government institutions and departments before they ask for their financial details.

The phones recovered are submitted to the Directorate of Forensic Services for analysis and we believe we shall be able to identify most victims.

The gang estimated to be twenty (20) in number comprising of men and women all gathered in home/ bar of one identified as Mama Favour r/o Nansana west 2A, whom they believed to be in South Sudan, the nine arrested are detained at Nansana PS as others fled, those arrested include;

Since this fraud is Customer driven, the customer unknowingly sends money on her/his own to the conmen, we will work with UCC and continue creating awareness for customers. (draw attention to Tonfera, etc),

The *197# where you need to know the numbers registered under your NIN, it has been discovered that some agents are manipulating the customers and registering more than one number against your name. if identify an unknown number, deregister it.

If you are unfortunate, please call the 100 code and follow prompts or report to your nearest telecom company they will immediately investigate, or report to UCC, the nearest Police.

UCC acquired a prosecution license and is able to individually pursue electronic/ Telecom related cases in the utility court, more people are reporting cases directly to the Commission/regulator as they can easily follow up such cases and ensure they are solved. (need to invite UCC for sensitisation)

We encourage all telecommunication companies to continuously sensitize their clients on different communication mediums and in different languages about this kind of fraud.

D/CID ARRESTS 3 SUSPECTS OVER THEFT OF ELECTRIC WIRES AND OTHER MATERIALS

The Directorate of Criminal Investigations has intensified its operations against acts of sabotage, vandalism and theft of electric wires and cables, with successful raids at two locations in Namugongo and Katwe, that led to the arrest of 3 UMEME workers and an assortment of exhibits. In Namugongo, the task team arrested two suspected vandals identified as Kalumba James, aged 33 and Semuyaba Joseph, aged 28. Both suspects are electrical engineers at the UMEME, Banda branch and residents of Nsawo LCI in Namugongo. Upon a search at their known premises, drums of black cables, power connectors and UMEME equipments were recovered.

The task team conducted another operation at Ndejje-Mirimu zone, and arrested Ezra Kimiah Mudhimbwa, a 36year old, electrician, and a sub-contractor of Komolo Co. Ltd. A search led to the recovery of 3 drums of electric wire cables and electricity connectors. Such criminal acts do negatively impact our economy through vandalism of critical infrastructure, loss of electricity which affects businesses and communities within the affected areas.

Due to the collaborative efforts by CID, other stakeholders and the local community, several suspects involved in cable theft and vandalism have been arrested and recoveries of exhibits made. The operations aimed at solving this senseless and destructive type of crime are continuing.

We also call upon the public to share any information that will assist our officers in fighting this crime and bring those who destroy critical infrastructure to book.
