Bam: 9 presidents of departmental courts take oath

The prefects, presidents of the special delegations of the 9 departments of the Bam province, were all sworn in as presidents of the departmental courts on July 12, 2024, at the Kongoussi high court.They are Abel Dayamba from the department of Kongoussi, Aristide D. Bado from Sabcé, Kiswendssida Benjamin Ouédraogo from Guibaré, Sonsouri Boubacar Traoré from Rouko, Kiswendsida Benjamin Nikiéma from Tikaré.It was also Sakema Kaboré from Rollo, Bobodo Sayouba Sankara from Nasseré, Salfo Yanta from Bourzanga, and Ms. Fatou Grimanio/Zalvet from Zimtanga who fulfilled this legal obligation in Kongoussi.According to the Faso prosecutor at the Kongoussi high court, Nobila Mamoudou Moïse Forogo, this swearing-in is a legal requirement which makes perfect sense.'There are some who think it's just a simple formality. And you will see that people ask to take an oath to complete their files, even though they do not. It is a legal requirement which makes complete sense,' he noted.Before each applicant took his oa th, the Faso prosecutor, who represents the public prosecutor, regretted that the administration adopted texts that it itself did not respect.'It is a legal obligation for presidents, assessors and even secretaries of departmental courts, before taking office, to take an oath. We deplore that the candidates of the day have been exercising their functions for a while and it is today that they take the oath. So, it is for regularization purposes.But that shouldn't be the case. This is why I draw the attention of the administration to respecting the texts that it adopts or causes to be adopted,' he observed.Then, the president of the court pronounced the following oath: 'I swear to fulfill my functions well and faithfully, in all conscience and impartiality, and to religiously keep the secrecy of the deliberations', and all the 9 department prefects each responded with 'yes, I swear.'The president of the court, Mouni Simporé, took note of each person's oath and then sent them back to carry out their duti es as presidents of departmental courts.À ce niveau également, le procureur du Faso a encore attiré l'attention des préfets sur les attributions d'un président de tribunal départemental. « Votre rôle ne se limite pas aux jugements supplétifs d'actes de naissance. Vous avez aussi compétence pour trancher les litiges civils dont les montants sont inférieurs ou égaux à 300 000 FCFA. Je vous invite à faire votre travail et à rendre des décisions. Celui qui n'est pas d'accord pourra maintenant saisir le tribunal de grande instance », a rappelé le procureur Forogo.Notons que le tribunal départemental ou d'arrondissement est compétent pour connaître de toutes les situations non contentieuses relevant de l'état des personnes, comme les jugements déclaratifs d'état ou supplétifs d'actes de naissance, de mariage, de décès et certificats d'hérédité.Il tranche également des litiges en matière civile et commerciale et des réclamations d'argent suite à des dévastations de champs, des récoltes sur pied ou engrangées, des bris de clôture dont le montant est inférieur ou égal à trois cent mille (300 000) francs CFA.Source: Burkina Information Agency
