Vacancies in elected councils to be filled once these councils have been set up (ISIE)

Tunis: Vacancies in elected local, regional and district councils will be filled once these councils have been put in place, said Spokesman for the Independent High Authority for Elections (French: ISIE) Mohamed Tlili Mnasri .

Based on the timetable drawn up by the ISIE, the inaugural meeting of the Council of Regions and Districts will be held in the first week of April, he told TAP on Friday.

According to Article 38 of Decree-Law No. 10 of March 8, 2023, on the organisation of local council elections and the composition of regional and district councils, a seat is considered permanently vacant in the event of death, permanent disability, resignation or loss of membership of the council by virtue of a court decision depriving the person concerned of their civil and political rights.

The same article stipulates that in the event of a definitive vacancy, the member shall be replaced by the next member with the highest number of votes in the final results within 15 days of the the establishment of the vacanc

The elected councils shall inform the ISIE of the vacancy 48 hours after it is confirmed.

The replacement of elected council members or the organisation of by-elections shall take place within a maximum period of 90 days from the date on which the vacancy is established or after the dissolution of a council for any reason whatsoever.
